§ 6.16.010. Control of animals

  • It is unlawful for the owner or keeper:

    A. To permit an animal to run at large on public school grounds or public playgrounds;

    B. To permit a dog in public parks or beaches except on a leash and subject to all applicable park rules and regulations or ordinances regulating the use of parks; provided, however, that dogs may run off-leash in designated off-leash parks under the following rules:

    1. That any person who takes a dog into an off-leash area must have physical control of the dog by means of an adequate leash as described in Section 6.08.150 when entering and exiting the off-leash area and must maintain voice control over the dog at all times while in the off-leash area,

    2. All dogs in an off-leash area must be licensed and must display valid license tags attached to the dog collar,

    3. Dangerous dogs and potentially dangerous dogs are not permitted to use the off-leash area,

    4. Any person with a dog or other pet in his or her possession or under his or her control in any park shall be responsible and liable for the conduct of the animal, shall carry equipment for removing feces, and shall place feces deposited by such animal in an appropriate receptacle, and

    5. Any person who enters the off-leash dog park shall agree to the posted rules and regulations as a condition of use;

    C. To permit any animal to enter a church, market or other place where food is stored, prepared, served or sold to the public or any other public place or hall, except for animal shows or other exhibition purposes, veterinary hospitals, kennels or places for which the licensing official has issued a permit under provisions of this title, or organized dog training classes where at least twenty-four hours advance notice has been given to the official by such persons requesting to hold such animal shows, exhibitions or dog training classes; provided, however, that this subsection shall not apply to any person using a dog guide and/or service animal;

    D. To permit a female dog to run at large while in heat (estrus);

    E. To permit a dog to roam, run, stray or to be away from the premises of the owner or custodian or to be on any public place or on any public property not designated as an off-leash park developed for that purpose or the private property of another in the city, unless such dog while away from such premises is controlled by a leash or chain not more than eight feet in length, such control to be exercised by the owner or custodian or other competent and authorized person; and any dog found roaming, running, straying or being away from the premises of the owner or custodian and not under control as provided in this section may be impounded subject to redemption in the manner provided by ordinance;

    F. To be in violation of Chapter 6.36 of this code;

    G. To harbor or permit a barking dog as defined in Section 6.08.060;

    H. To keep, harbor or maintain animals known to have a contagious disease unless under the treatment of a licensed veterinarian;

    I. For any person owning or having control of any cattle, horses, goats, swine or sheep to permit or suffer such animals to escape from the premises owned, leased or occupied by the owner or custodian of such animals, or to run at large onto the streets, sidewalks or ways of the city or upon any property therein not owned, leased or occupied by such person;

    J. For the owner or keeper of cattle, horses or goats to stake out to tether such animals along the public ways of the city or upon the property of any person other than the owner or person having custody of such animals without the prior consent of the owner, lessee or occupant of the land upon which such animals are staked or tethered;

    K. To permit a dog within the boundaries of any public cemetery, whether or not such dog is on a leash. This prohibition does not apply to dogs kept within any vehicle;

    L. To permit a horse within the boundaries of any public cemetery.
